Proximity Advisors have broad and deep experience in advising on forms of discretionary payments, including:

Proximity has exceptional expertise in this field, with several former Commonwealth government General Counsels in our ranks, including two former Department of Finance General Counsel.

Skills and expertise

Our Advisors have the expertise and experience to advise you on all forms of discretionary payments, including:

  • Act of Grace payments: requests, advising on criteria and precedent, developing advice to relevant Ministers in situations not provided for by the law
  • Compensation for Defective Administration claims of all types: individuals and corporations, including assessing potential liability under very complicated legislative schemes
  • Dispute resolution: negotiating with applicants and plaintiffs; we are especially good at finding lateral (non-monetary) solutions to resolve disputes with unrepresented litigants
  • Ex gratia schemes: we have established several such schemes to resolve class actions against government, from setting up trusts, to preparing assessment criteria and application protocols, to negotiating with plaintiff lawyers
  • Finding solutions: because of our deep experience at senior levels in government, you don’t have to know what scheme applies to your situation for us to be able to help you –  bring us your problem and let us help you to the best outcome for your agency
  • Redress schemes: advising on and assessing claims; establishing frameworks and working with stakeholders.
